Plateau State Governor, Caleb Manasseh Mutfwang, expressed his dissatisfaction with the Court of Appeal’s decision to nullify his election, claiming unfair treatment. During his presentation to the Supreme Court, he highlighted eight points that were initially submitted to the Court of Appeal to validate his election. However, only one point was considered, and he contended that he was denied a fair hearing by the Appellate Court.
Mutfwang argued that the dismissal of the seven issues by the Court of Appeal contradicted the Supreme Court’s directive for intermediate courts to address all presented issues. He appealed to the Supreme Court to affirm his election as the valid governor of Plateau State.
Presenting his case with an eight-man team of Senior Advocates of Nigeria, led by Kanu Agabi, Mutfwang emphasized the legal principle that demands a remedy for any wrongdoing. The hearing of his brief is scheduled for Tuesday at the Supreme Court.
Mutfwang asserted, “Eight issues were presented to the court below for determination. Unfortunately, only one issue, regarding jurisdiction, was addressed, leaving the remaining seven untouched. This contravenes the established practice that intermediate courts should address all issues to provide the apex court with a comprehensive understanding for potential further consideration.”
Insisting on the denial of fair hearing, Mutfwang urged the Supreme Court to overturn the Court of Appeal’s judgment that invalidated his election. He argued, “Given the denial of fair hearing to the Appellant concerning the Notice of Preliminary Objection and a Motion to strike out the incompetent Grounds of Appeal, the decision of the lower Court to dismiss them is, with all due respect, manifestly flawed.”
