Edo Guber: Six Political Parties Challenge APC’s Victory at Tribunal Over Alleged Irregularities

Six political parties have officially petitioned the Edo State election tribunal, contesting the declaration of Senator Monday Okpebholo of the All Progressives Congress (APC) as the winner of the September 21, 2024 governorship election. The Independent National Electoral Commission (INEC) announced Okpebholo’s victory on September 22, 2024, with a total of 291,667 votes, surpassing 17 other candidates, including his closest rival, Asue Ighodalo of the Peoples Democratic Party (PDP), who garnered 247,274 votes.

The parties challenging the election results include the PDP, Social Democratic Party (SDP), Zenith Labour Party (ZLP), Action Democratic Party (ADP), Accord Party (AP), and the Allied Peoples’ Movement (APM). They have collectively requested the nullification of the election due to alleged noncompliance with the mandatory provisions of the Electoral Act.

In its petition, the ADP argued that INEC, as the first respondent, should have nullified the election and called for a fresh one, emphasizing the need for adherence to the Electoral Act 2022 and the accompanying Regulations and Guidelines.

The APM, ADP, ZLP, and SDP are specifically contesting results from nine local government areas won by the PDP, as well as one local government area won by the APC. The local governments in question include Esan North East, Esan South West, Igueben, Okpoba Okha, Orhionmwon, Ovia South West, Ovia North East, and Uhunmwonde, which were claimed by the PDP, along with Egor, won by the APC.

The SDP’s petition asserts that no legitimate winner could emerge from an election conducted in significant violation of the Electoral Act. They allege that INEC’s failure to electronically transmit collated votes at polling units invalidated the votes assigned to the APC, rendering its declaration as the election’s winner a nullity.

The ADP contends that all votes accredited to the APC and other candidates are invalid due to fundamental breaches of the Electoral Act and Regulations during the election. They also argue that INEC should have annulled the election and conducted a new one, ensuring compliance with the Electoral Act 2022 and its guidelines.

In its petition, the ZLP is requesting that the tribunal declare the APC’s return as the election winner invalid due to corrupt practices and noncompliance with the Electoral Act 2022 and the established regulations.
